Can you get unemployment benefits after resigning?

Usually not straight away. In Belgium, resigning makes you voluntarily unemployed, and the ONEM can exclude you from benefits for 4 to 52 weeks, or give a warning instead. Since 1 March 2026, a rebound right lets workers with about 10 years of work history convert that exclusion into up to six months of benefits, once in their career. Benefits are now limited to 12 to 24 months overall.

What happens to your benefits if you resign?

You are considered voluntarily unemployed, because you chose to leave. Unemployment benefits are meant for involuntary unemployment, so the ONEM can sanction you with an exclusion of 4 to 52 weeks, which can also be replaced by a warning or suspended. In practice the average exclusion is about 8 weeks, according to Droits Quotidiens.

Since 1 March 2026, benefits are also limited in time: 12 months at least, up to 24 months depending on your work history, as the ONEM explains. An exclusion does not add time at the end: it is taken out of that total. The Constitutional Court upheld this limit on 10 September 2026.

‍

Can you avoid the exclusion?

Yes, if you can show the job you left was not suitable. An employer that fails its duties on well-being at work and does not fix the problem despite repeated requests is one example given by Droits Quotidiens. The burden of proof is on you, so keep written traces.

If you are unsure, you can ask the ONEM for an advance decision before you resign: it tells you which sanction you would face, including the number of weeks of exclusion. It is the safest step if you plan to resign without a new job lined up.

‍

What is the rebound right?

A measure in force since 1 March 2026 that lets you receive benefits after a resignation, once in your career. You need at least 3,120 days of work, about 10 years. Benefits last up to six months, or up to 12 months if you start and complete a training for a shortage occupation in the first three months, according to Droits Quotidiens.

It is not automatic. You first apply for benefits and receive an exclusion decision from the ONEM. Then, within 30 days of that decision, you ask through your payment body, with the C109 form, to convert the exclusion into benefits.

‍

What does this mean if you are about to resign?

That the safest resignation is one with a signed contract elsewhere. Benefits are the fallback, and after a resignation they are neither immediate nor guaranteed.

If you plan to leave without a job, count on several weeks without income, check whether you qualify for the rebound right, and ask for an advance decision. Then follow the formalities in how to resign step by step. You can also start looking before you resign, for instance among the IT and engineering roles currently open.

What is temporary unemployment, and who pays?

Temporary unemployment means your employment contract is suspended for a period, for example because of a lack of work for economic reasons, bad weather or force majeure. You are not dismissed. The ONEM pays you an allowance of 60% of your capped gross pay, or 65% for force majeure, with 26.75% withholding tax, and your employer pays a daily supplement on top.

What is outplacement, and who is entitled to it?

Outplacement is job-search support paid by your employer when it dismisses you. In Belgium it is mandatory in two cases: if your notice period or indemnity is at least 30 weeks, whatever your age, or if you are 45 or older with at least one year of seniority and a shorter notice. It is not owed after a resignation or a dismissal for serious misconduct. It usually means 60 hours of coaching.

How do you resign from a job in Belgium, step by step?

To resign in Belgium, you give your employer a written notice stating when your notice starts and how long it lasts. You can hand it over in person against a signed copy, send it by registered letter or have it served by a bailiff. The notice starts on the Monday after the week it is received. Without the start date and the duration, the notice is void.
